A few years ago a group of Muslims objected to handling dog food and pork while working as check-out associates at Target. I said do the job, quit, or be terminated. I feel likewise about the Clerk in Kentucky. Gay marriage is the law of the land. You don't have to agree. If handing out marriage licenses to gay couples is morally objectionable, you can quit. There is no other legal choice and refusing to do your job should be grounds for termination. No one is forcing her to break her moral code. She does have an option, not a good option, but an option. It is no different than the Target Store workers.
When the man signs your check, you do what he says or quit. Life works that way.
If I understand correctly, and it seems underreported, there is no law in that state that she may issue a license in accordance with.

I agree with Joe, what I find interesting is that the gay protesters could have gone to any other county to get a license. This has nothing to do with a happy marriage it's all about shoving a life style in everyone's face. As far as I am concerned the gay mafia is no different than the Clan or the Black Panthers.

Here's the way I see it. Whether or not there is a law regarding the issuance of marriage licenses in Kentucky is immaterial, because clearly such licenses were being issued and there was a sense -- perhaps we should call it a common-law perception -- that they were required for a legal marriage (just as they are in many places). If she was issuing them on a regular and normal basis to straight couples, then the court is correct; she has to issue them to gay couples, too.
ReplyDeleteNormally I'd be on her side, like I was with the cake makers and photographers and pizza restaurants, even though we have laws about public accommodation (which FWIW I think are being sorely misinterpreted, but that's an argument for another day). However, in Ms. Davis's case, the solution was simple: Honorably resign from your elected position. That she did not, and still refused to do what she was told to do, indicates that she has no honor. In my opinion, she deserves to be sitting in that jail cell, whether there is a written law to be followed or not.

ReplyDeleteI would like to state that the government should not be in the marriage business in the first place. Their only role should be to register said marriage just as the register a deed or title.

Then we would not have the issue in Kentucky or the coming fight and protests by the gay mafia when the local First Baptist refuses to Mary Jon and Dave or Sue and Sally. That fight is coming soon and it will be ugly. Kennedy alluded to it in his opinion and indicated how he will rule.
